Welcome to THE LINEUP. These Terms of Service ("Terms") govern your use of our website, services, and products (collectively, the "Service"). By accessing or using THE LINEUP, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Service Description

THE LINEUP provides AI-powered NBA player projections and sports betting analytics tools, including projection tracking, betting value identification, arbitrage detection, and performance analysis. Our projections are generated using machine learning models trained on historical NBA data.

2. Nature of Service - Important Disclaimers

2.1 What THE LINEUP Is

THE LINEUP is a sports analytics and media company that provides AI-powered projections, statistical analysis, and betting analytics tools. We are an informational and entertainment service only.

2.2 What THE LINEUP Is NOT

THE LINEUP is NOT:

• A sportsbook, casino, or gambling operator
• A licensed gambling platform or betting exchange
• A financial advisor, investment advisor, or fiduciary
• A provider of personalized betting advice or recommendations
• Affiliated with, endorsed by, or sponsored by the NBA, NFL, NCAA, Yahoo, or any sports league, team, or gambling operator

We do not accept wagers, place bets on your behalf, hold customer funds, or facilitate gambling transactions of any kind. All betting activity occurs on third-party sportsbooks that are entirely separate from THE LINEUP.

2.3 No Personalized Betting Advice

THE LINEUP does not provide personalized betting advice. We cannot know all the relevant facts about you, including your financial situation, risk tolerance, betting experience, or individual needs. Our projections and analytics are general information only and do not constitute a recommendation that any particular bet is suitable for you.

The best person to make your betting decisions is you. By using our Service, you agree that you bear sole responsibility for your own betting decisions and activities.

2.4 Entertainment and Informational Purposes Only

All content, projections, analytics, odds comparisons, and recommendations provided through THE LINEUP are for informational and entertainment purposes only. Nothing on our Service constitutes betting advice, financial advice, or a solicitation to gamble.

3. Account Registration & Eligibility

To use certain features of THE LINEUP, you must create an account. You represent and warrant that:

• You are at least 18 years old (or 21 years old in jurisdictions where that is the legal gambling age)
• You meet the legal age requirements for sports betting in your jurisdiction
• You will provide accurate and complete registration information
• You will keep your password secure and confidential
• You will notify us immediately of any unauthorized account access
• You will not share your account with others

You are responsible for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or restrict access at our sole discretion.

4. Jurisdiction & Legal Compliance

By using THE LINEUP, you acknowledge and agree that:

• Sports betting is not legal in all jurisdictions
• It is your sole responsibility to determine whether sports betting is legal in your jurisdiction before engaging in any betting activities
• THE LINEUP makes no representations or warranties regarding the legality of sports betting in your location
• You will not use THE LINEUP to facilitate illegal gambling activities
• You will comply with all applicable local, state, national, and international laws and regulations

THE LINEUP is not responsible for any legal consequences you may face from betting activities in jurisdictions where such activities are prohibited or restricted.

5. Subscription Tiers & Pricing

THE LINEUP offers multiple subscription tiers:

• Free Tier: Limited to 10 player projections per day, median projections only, today's games only.
• Pro Tier ($24/month or $228/year): Unlimited player access, floor/median/ceiling projections, full season projections, CSV export, ad-free experience.
• Elite Tier ($49/month or $468/year): All Pro features plus advanced analytics, arbitrage tools, API access, and Discord premium channel.

All prices are in USD. Subscriptions automatically renew unless canceled before the renewal date. We reserve the right to change pricing with 30 days notice to existing subscribers.

6. Payment & Billing

Payment processing is handled securely through Stripe. By subscribing to a paid tier:

• You authorize us to charge your payment method on the subscription renewal date
• You agree to provide current, complete, and accurate payment information
• You must update your payment information if it changes or expires
• Failed payments may result in suspension or termination of your subscription

We do not store your credit card information. All payment data is securely processed and stored by Stripe in compliance with PCI-DSS standards.

6.1 Apple App Store Purchases (iOS)

For subscriptions purchased through the Apple App Store:

• Payment will be charged to your Apple ID account at confirmation of purchase.
• Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Apple App Store subscription prices: Pro Monthly ($7.99/month), Pro Annual ($69.99/year), Elite Monthly ($24.99/month), Elite Annual ($179.99/year). Prices may vary by region and are subject to change.

7. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation:

• You will retain access to paid features until the end of your current billing period
• No refunds will be issued for partial billing periods
• Your account will automatically downgrade to the Free tier after the period ends

8. Acceptable Use Policy

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Use the Service to facilitate illegal gambling in any jurisdiction
• Scrape, crawl, or automatically extract data from the Service
• Attempt to bypass free tier limits or access controls
• Reverse engineer, decompile, or disassemble any part of the Service
• Share your account credentials with others
• Resell, redistribute, or commercially exploit our projections or data without authorization
• Use the Service to harass, abuse, or harm others
• Upload viruses, malware, or malicious code
• Interfere with or disrupt the Service or servers

We reserve the right to suspend or terminate accounts that violate these terms.

9. Intellectual Property

THE LINEUP and all related trademarks, logos, and content are owned by us or our licensors. NBA player names, statistics, and team information are used under fair use principles and/or license from third-party data providers.

Third-Party Trademarks: NBA, NFL, NCAA, Yahoo, and all team names, logos, and related marks are trademarks of their respective owners. THE LINEUP is not affiliated with, endorsed by, or sponsored by any of these organizations.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code.

10. Betting Disclaimer & Limitation of Liability for Betting Losses

10.1 No Guarantee of Results

All projections, statistics, odds comparisons, and recommendations provided by THE LINEUP are estimates based on historical data and statistical models. They are NOT guarantees of future performance. Player and team performance is inherently unpredictable due to injuries, matchups, coaching decisions, weather, and countless other factors.

Past projection accuracy and historical model performance DO NOT guarantee future results. A projection that was accurate yesterday may be wrong tomorrow. There is no such thing as a "guaranteed winner" or "lock" in sports betting.

10.2 Your Sole Responsibility for Betting Decisions

By using THE LINEUP, you expressly acknowledge and agree that:

• Any betting decisions you make are YOUR SOLE RESPONSIBILITY
• You make all betting decisions at your own risk
• You should conduct your own research and due diligence before placing any bets
• You should never rely solely on THE LINEUP's projections for betting decisions
• You should always use multiple sources of information
• You should only bet with money you can afford to lose

10.3 We Are Not Liable for Your Betting Losses

THE LINEUP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY BETS MADE OR ACTIONS TAKEN BY YOU OR OTHERS BASED ON PROJECTIONS, ANALYTICS, ODDS, INFORMATION, OPINIONS, OR ANY OTHER MATERIAL PUBLISHED THROUGH OUR SERVICE.

This includes, without limitation:

• Any financial losses from betting activities
• Any losses resulting from reliance on our projections or analytics
• Any losses from following "best bet" recommendations or value plays
• Any losses from arbitrage or middle opportunities that did not materialize
• Any losses from inaccurate, delayed, or incomplete odds or line data
• Any losses from technical errors, outages, or service interruptions

10.4 Assumption of Risk

Sports betting involves substantial risk of loss. You may lose some or all of your wagered funds. By using THE LINEUP, you acknowledge that you understand these risks and voluntarily assume them. You agree that THE LINEUP has no duty to warn you of the risks of sports betting beyond what is stated in these Terms.

11. Data Accuracy & No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE:

• The accuracy, completeness, or timeliness of projections, statistics, or odds data
• That odds or lines displayed reflect current sportsbook offerings
• That the Service will be uninterrupted, error-free, or secure
• That any errors will be corrected
• That the Service will meet your specific requirements
• That our projections will result in winning bets

Odds, lines, and betting data are sourced from third-party providers and may be subject to delays, errors, or inaccuracies. Always verify current odds with your sportsbook before placing any bets.

12. General Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LINEUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless THE LINEUP, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from any claims, losses, damages, liabilities, costs, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your betting activities, including any losses you incur
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Your violation of any rights of another party
• Any content you submit or transmit through the Service

• Lying to family or friends about gambling activities
• Feeling restless or irritable when trying to reduce gambling
• Using gambling as an escape from problems or negative feelings

14.3 Responsible Gambling Tips

• Set a budget before you start and stick to it
• Never bet more than you can afford to lose
• Set time limits for your gambling sessions
• Never chase your losses
• Don't gamble when upset, stressed, or under the influence
• Take regular breaks
• Balance gambling with other activities
• Use self-exclusion tools offered by sportsbooks if needed

Most sportsbooks offer responsible gambling tools including deposit limits, loss limits, session time limits, and self-exclusion programs. We encourage you to use these tools.

15. Dispute Resolution, Arbitration & Class Action Waiver

15.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to contact us at support@thelineup.pro to attempt to resolve any dispute informally. We will attempt to resolve the dispute within 30 days.

15.2 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. The arbitration shall be conducted in English, and the seat of arbitration shall be in the State of California, United States.

15.3 Class Action Waiver

YOU AND THE LINEUP AGREE THAT ANY PROCEEDINGS TO RESOLVE DISPUTES WILL BE CONDUCTED SOLELY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION. YOU EXPRESSLY WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

If any court or arbitrator determines that this class action waiver is void or unenforceable for any reason, or that arbitration can proceed on a class basis, then the arbitration provision shall be deemed null and void, and any resulting dispute shall be resolved in court.

15.4 Time Limitation

Any claim or dispute must be filed within one (1) year from the date it could first be filed, or the claim is permanently barred.

15.5 Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized use of trade secrets without first engaging in arbitration.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice on the Service at least 30 days before changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

17. Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity
• Use of the Service to facilitate illegal gambling
• Extended periods of inactivity (12+ months)
• Non-payment of subscription fees
• Any other reason at our sole discretion

Upon termination, your right to use the Service will immediately cease. We may delete your account data in accordance with our Privacy Policy. Sections 10-13 (liability and indemnification) shall survive termination.

18. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in California.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and THE LINEUP regarding your use of the Service. These Terms supersede any prior agreements or communications between you and THE LINEUP regarding the Service.
